    California is an at-will employment state (Cal. Labor Code §2922) — your employer can generally end your job at any time for any reason that isn’t illegal. The exceptions are what most wrongful-termination cases turn on: you can’t be fired because of a protected characteristic (race, gender, age, disability, etc.), in retaliation for reporting wrongdoing, for taking protected medical leave, or for refusing to do something illegal. If your firing crosses one of those lines, “at-will” doesn’t protect the employer. Learn about California at-will exceptions.

    A layoff is a job ending for business reasons — restructuring, downsizing, eliminating a role — that doesn’t single you out illegally. Wrongful termination is when your firing is based on an illegal reason (discrimination, retaliation, protected leave, refusal to break the law) even if the employer calls it a “layoff” or “position elimination.” If you were the only one in your role or department cut, or your job was filled soon after by someone outside your protected category, the layoff label may not survive a closer look.     Constructive discharge is when your working conditions become so intolerable — harassment, demotion, a hostile environment, retaliation for protected activity — that any reasonable person would feel forced to resign. California recognizes this as a form of wrongful termination (Turner v. Anheuser-Busch, Inc. (1994) 7 Cal.4th 1238), so yes, you can sue. The harder part is proving the conditions were severe enough that staying wasn’t a realistic option, which is why documenting incidents, witnesses, and dates before you walk away matters.     Yes — quitting doesn’t waive your right to sue for a hostile work environment. Under California’s Fair Employment and Housing Act (Gov. Code §12940), you generally have three years from the harassment to file a complaint with California’s Civil Rights Department, regardless of when you left.     Most LA-based employment lawsuits go to Los Angeles Superior Court — typically the Stanley Mosk Courthouse downtown, with branches in Norwalk, Pomona, and Van Nuys depending on where the employer did business. Most California employment claims (FEHA discrimination, harassment, retaliation, wrongful termination) stay in state court. A smaller set of federal-only claims would go to the U.S. District Court for the Central District of California in downtown LA — though plaintiff-side lawyers usually keep cases in state court when both options exist. Where your case lands affects timeline, jury pool, and motion practice.

    For discrimination, harassment, or retaliation claims under California’s Fair Employment and Housing Act, you have to file with California’s Civil Rights Department (CRD) first — it’s a required administrative step before you can sue. CRD investigates, may try to mediate, and eventually issues a “Right-to-Sue” notice. With that notice in hand, you can file in LA Superior Court within one year.

    From the day you file the complaint to a resolution, most LA Superior Court employment cases take 12 to 24 months. The exact timeline depends on the assigned department, motion practice, whether discovery gets contested, and whether your case settles before trial. Many cases settle in mediation between months 6 and 18; trials can stretch longer if the court calendar is backed up.
